The mining sector continues to be at the fulcrum of many countries’ economic development. The subject of mining, though nearly as old as humankind itself, today remains at the heart of many debates. These debates have been fuelled by issues that seem to engulf the sector, among them social responsibility, taxation and environmental protection.

This has changed the traditional approach to the study of mining regulation, from mere legal analysis to dealing with more complex issues relating to the role of citizens, the state, local authorities and courts to ensure sustainable mining practices.

A cursory review of the history of mining in Zambia demonstrates that mining legislation has undergone numerous changes, and yet the field of mining law remains bereft of accessible and up to date academic literature and publications. It expounds on the view that mining activities deface the environment and, as such, the need for environmental protection must be considered.
